Please read these Terms of Service (“Terms”) carefully before using Blabble (“Blabble,” “we,” “us,” or “our”), accessible at www.blabble.chat (the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
You must be at least 18 years of age to use the Service. By accessing or using the Service, you represent and warrant that you are 18 or older. If we discover or reasonably believe that an account belongs to someone under 18, we will immediately terminate the account and delete associated data without notice. The Service involves live video interaction with strangers and is not suitable for minors.
You may use the Service as a guest (without registering) or by creating an account. If you create an account, you agree to:
We reserve the right to suspend or terminate accounts that violate these Terms.
You may not use a display name that is offensive, discriminatory, impersonates another person or entity, or otherwise violates these Terms. We reserve the right to reject, change, or remove any display name at our sole discretion without notice.
You agree not to use the Service to:
The Service provides live, peer-to-peer video and audio sessions with other users. You consent to being visible and audible to your matched partner during a session. You acknowledge that your partner may be a stranger and that Blabble does not vet, endorse, or guarantee the conduct of any user. You use live sessions at your own risk. We strongly encourage you to report any conduct that violates these Terms.
Recording prohibition: You may not record, screenshot, or capture any portion of another user's video or audio during a session without their explicit consent. You may not upload, share, or distribute any such recording under any circumstances. Violations of this prohibition may result in permanent account termination and potential legal action.
We provide an in-session reporting tool. When you submit a report, a still image of the session may be captured and transmitted to our moderation team as evidence. Reports are reviewed by Blabble staff and may result in warnings, temporary suspensions, or permanent bans. Moderation decisions are at our sole discretion and are final. Abuse of the reporting system (e.g., filing false reports) may itself result in enforcement action.
The Service and its original content, features, and functionality are and will remain the exclusive property of Blabble and its licensors. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent. The Blabble name, logo, and associated marks are trademarks of Blabble and may not be used without permission.
The Service may offer purchasable virtual items or subscriptions (“Pro” features). All purchases are final and non-refundable except where required by applicable law. Virtual items have no real-world monetary value, are not transferable, and may be modified or removed at any time. We reserve the right to change pricing at any time with reasonable notice.
The Service integrates with third-party services including Google (for authentication) and LiveKit (for real-time video infrastructure). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the practices of any third-party service.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLABBLE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS (USD $100).
You agree to indemnify, defend, and hold harmless Blabble and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any third-party right.
We may suspend or terminate your access to the Service at any time, with or without cause or notice, at our sole discretion. Upon termination, your right to use the Service ceases immediately. Sections 7, 10, 11, 12, and 14 survive any termination.
These Terms are governed by and construed in accordance with the laws of the State of Maryland and the federal laws of the United States of America, without regard to its conflict-of-law provisions. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Maryland for any disputes not subject to arbitration. Any dispute arising under these Terms shall be resolved through binding arbitration on an individual basis (not as a class action), except that either party may seek injunctive relief in a court of competent jurisdiction for claims involving intellectual property or unauthorised access.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the effective date above and, where appropriate, by sending a notice to the email address associated with your account. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
